Conditions applicable to subscription to the Play-Planner software
Article 1 - Purpose
These Terms and Conditions of Sale govern the provision of the Play-Planner management software, published by Xavier Fourcade, sole proprietor.
These Terms apply to any subscription to the Play-Planner service by a professional (surf school, water sports center, or any similar structure).

Article 3 - Service Description
Play-Planner is a SaaS (Software as a Service) software designed for complete management of surf schools and similar structures. It includes:
- Instructor scheduling management
- Client and family management
- NF525 compliant billing
- Online bookings (optional module)
- Equipment rental (optional module)
- Surf camps management (optional module)
- Communication (email, SMS, WhatsApp)
- Statistics and monitoring
Article 4 - Pricing
Play-Planner pricing is customized based on:
- Team size (number of instructors)
- Optional modules subscribed
- Features activated
Prices are communicated individually upon quotation after analysis of each client's specific needs.
No commission is charged on bookings or sales made through the software.
Article 5 - Payment Terms
Payment is made according to the terms defined in the accepted quotation:
- Payment by bank transfer
- Payment by credit card
- Monthly, quarterly or annual billing
Invoices are issued in accordance with French tax regulations and sent by email.
Article 6 - Duration and Termination
The contract is subscribed for a fixed period (monthly, quarterly or annual) renewable by tacit renewal.
Either party may terminate the contract at any time, with one month's notice, by email to xavierfourcade@fastmail.com.
In case of termination, access to the software remains active until the end of the paid period.
Article 7 - Client Obligations
The client agrees to:
- Provide accurate information upon subscription
- Use the software in accordance with its intended purpose
- Not resell, transfer or subcontract access to the software
- Respect intellectual property rights
- Inform Xavier Fourcade of any anomaly detected
Article 8 - Xavier Fourcade's Obligations
Xavier Fourcade agrees to:
- Provide functional software compliant with its description
- Ensure service availability within reasonable limits
- Guarantee data security and confidentiality
- Provide personalized support and assistance
- Perform regular data backups
Article 9 - Intellectual Property
The Play-Planner software, its source code, documentation and all its components are the exclusive property of Xavier Fourcade.
Subscription to the service only grants a personal and non-transferable right to use the software.
Article 10 - Data and Confidentiality
Data entered by the client in Play-Planner remains the client's exclusive property.
Xavier Fourcade agrees not to exploit, sell or transfer this data to third parties.

Article 11 - Liability
Xavier Fourcade makes every effort to ensure software stability and security. However, liability cannot be engaged in case of:
- Misuse of the software by the client
- Force majeure or fortuitous event
- Temporary interruption related to maintenance
- Internet network failure
In any case, Xavier Fourcade's liability is limited to the amounts actually received under the contract.
Article 12 - Applicable Law and Disputes
These Terms are governed by French law.
In case of dispute, the parties agree to seek an amicable solution before any legal action.
Failing amicable agreement, any dispute will be submitted to the competent courts within the jurisdiction of Xavier Fourcade's registered office.
